TERMS AND CONDITIONS OF AYOCONNECT PRODUCT PURCHASING IN LIVIN’ APPLICATION SUKHA MENU
Terms and conditions of Ayoconnect purchasing in Livin’ Application Sukha Menu (hereinafter referred to as “Terms and Conditions”) regulates the purchasing procedure Ayoconnect, prepared based on Ayoconnect terms and conditions.
GENERAL TERMS
- Livin’ Application is Livin’ by Mandiri mobile banking application, which is owned and operated by Bank Mandiri.
- Livin' Sukha is a feature in the Livin' app that provides various offers on goods and services to meet a range of customer needs.
- Bank Mandiri is PT Bank Mandiri (Persero) Tbk legally domiciled in Jakarta.
- Ayoconnect which is PT Ayoconnect Teknologi as a partner product provider collaborating with Bank Mandiri
- User is Bank Mandiri customers who conduct Transactions on Livin' Sukha.
- Transaction is the process of purchasing Product on Livin’ Sukha by the User.
- Product is Voucher Code Google Play and Game skin provided by Ayoconnect.
- Data Privacy is the the data of the User that is individually identified or can be identified either separately or in combination with other information, whether directly or indirectly, through electronic or nonelectronic systems.
TERMS OF SERVICE
- Ayoconnect provides products that can be purchased by User through Livin' Sukha. By making a purchase of the Product, User are deemed to have read, understood, and agreed to all the contents of these Terms and Conditions as well as the terms and conditions directly governed by Ayoconnect. - The provision of Products through Livin' Sukha represents a collaboration between Ayoconnect and Bank Mandiri. Purchases made by User through Livin' Sukha establish a legally binding contractual relationship between the User and Ayoconnect. In this capacity, Bank Mandiri acts solely as a facilitator, displaying the menu for Product purchases and facilitating the processing of Product payments.
- By conducting the Transaction, User agrees:
- Will not copy any information including services available within Livin' Sukha for any purpose other than the purpose of purchasing Products;
- Will not download, reproduce or display any products, information or services available on Livin' Sukha for any purpose other than the purpose of purchasing Products;
- Will not use and/or access the Livin' Sukha system directly or indirectly in whole or in part in any way that can weaken, damage, interfere with or inhibit, limit, and/or take over the functionality and integrity of the software or hardware systems, networks, and/or data on Livin' Sukha;
- User's Personal Data including but not limited to name, place and date of birth, gender, telephone number, and/or email may be provided to Ayoconnect for the purpose of purchasing Products. The User gives consent to Bank Mandiri and/or Ayoconnect to be able to process the User's Personal Data in order to improve the quality of Livin' Sukha services for the User; Details of the Ayoconnect privacy policy can be accessed by User through the link https://www.ayoconnect.com/privacy-policy
- The User gives consent to Ayoconnect and/or Bank Mandiri to share the User's Personal Data with other legal entities and/or individuals in connection with the User's purchase of the Product for purposes permitted by applicable regulations.
- All User data submitted in the Product purchase process will be documented and used by Ayoconnect in accordance with applicable data protection and consumer protection provisions
TERMS OF PURCHASE OF DIGITAL VOUCHER
- In purchasing the Product, the User is required to fill in the User's data completely and correctly. In the event that there is an error in filling in the data that causes harm to the User and/or any third party, it shall be the sole responsibility of the User.
- Before making a purchase, the User must read and understand the overall information related to the Product, including but not limited to the description, function, variant, quality, how to use, and compatibility of the Product.
- In purchasing the Products, the User may make payment in accordance with the payment options provided by Bank Mandiri on the Livin' Application.
- For payment transactions that use the direct debit method from the User's account, the User must ensure that the balance in the account is sufficient.
- If the User uses other payment methods such as credit cards, then the terms of use refer to the terms of each product applicable at Bank Mandiri, including butnot limited to fees, interest, and/or penalties.
- Product availability is subject to change at any time and is the responsibility of Ayoconnect. In the event that the Product stock is not available, Ayoconnect has the right to refuse and/or cancel the purchase of the Product which will be informed by Ayoconnect through the Livin' Application and/or other media in accordance with the provisions of Ayoconnect and Bank Mandiri.
- The transaction will be processed after the User's payment is successfully verified and the User will get a confirmation of Product purchase from Ayoconnect through email noreply@ayoconnect.id
PRICE & PROMOTION
- The price for each Product listed on Livin' Sukha is the price set by Ayoconnect and may change at any time. Transactions at Livin' Sukha can only be made in Rupiah currency.
- Fees may vary per Transaction depending on the type and quantity of Products purchased with details that the User can see before making payment.
- Ayoconnect may offer lower prices and/or promotions from time to time through Ayoconnect official means of communication and/or other platforms in accordance with the terms and conditions applicable at Ayoconnect. In the event that any promotions are provided by Ayoconnect directly outside of Livin ’ Sukha, then the right and authority over such promotions rests solely with Ayoconnect and may not apply to Transactions on Livin’ Sukha.
CANCELLATIONS, ORDER CHANGES, AND/OR REFUNDS
- Cancellation requests can only be made before the Transaction is processed by Bank Mandiri.
- Users may not apply for cancellation, order change, and/or refund of successful transactions for any reason.
REPRESENTATIONS & WARRANTIES OF USER
- The User understands and agrees that all Product descriptions included in Livin' Sukha come from Ayoconnect so that Bank Mandiri does not provide any guarantee including the quality of the Product, its suitability to the User's expectations, and the period of delivery of the Product to the User. All such matters are the sole authority and responsibility of Ayoconnect.
- The User understands and agrees that the Product specifications, including but not limited to colors, as displayed on Livin' Sukha are only illustrations of Ayoconnect and depend on the monitor or screen of the User's mobile phone so that any discrepancies in Product specifications are the sole responsibility of Ayoconnect.
- The User hereby authorizes Bank Mandiri to debit and/or credit the User's payment source in order to include but not limited to payment, correction of Transaction, or refund.
- The User understands and agrees that although the Product and/or fulfillment of these Terms and Conditions is the authority of Ayoconnect, the provisions of payment transactions and the use of the Livin' Application in these Terms and Conditions are part of Bank Mandiri's Terms and Conditions so that all matters related to transaction aspects including but not limited to instructions given by the User, the use of the Livin' Application, and / or Bank Mandiri's privacy policy are subject to the provisions of fund products at Bank Mandiri and the Livin' Application Terms and Conditions. There are no provisions in these Terms and Conditions that reduce or limit the validity of the representations and warranties provided by the User in the Livin' Terms and Conditions.
INDEMNIFIKASI
- Ayoconnect and/or Bank Mandiri shall not be liable or indemnified in any form whatsoever to any party for all claims, demands and/or other legal actions of any nature whatsoever for the delay and/or failure of Ayoconnect and/or Bank Mandiri to fulfill its obligations in relation to the purchase of the Products due to events or causes beyond Ayoconnect and/or Bank Mandiri's control or ability, including but not limited to natural disasters, fire, war, riots, sabotage, system disruptions, power disruptions, telecommunications disruptions, and/or government policies.
- Ayoconnect and/or Bank Mandiri do not provide any representations, warranties or guarantees including guarantees of satisfactory quality, fitness for a purpose, accuracy, reliability and freedom from malware, phishing emails, in connection with the purchase of Products through Livin' Sukha.
- Electronic documents issued by Ayoconnect and/or Bank Mandiri in connection with the purchase of Products shall constitute valid evidence and shall bind the User and the User shall not deny the truth of such electronic documents.
- The content of the implementation, and fulfillment of these Terms and Conditions is the authority of Ayoconnect. In the event of any problems experienced by the User in relation to the Products, Bank Mandiri may, with Bank Mandiri's best endeavors, assist in bringing the User together with Ayoconnect to seek a resolution of such problems. However, the settlement shall be made by the User with Ayoconnect so that Bank Mandiri shall have no liability whatsoever for any problems or disputes arising between the User and Ayoconnect, including taking any legal action deemed necessary by the User and Ayoconnect
MISCELLANEOUS
- Ayoconnect through Bank Mandiri reserves the right to amend these Terms and Conditions and such amendments shall become effective upon notification from Bank Mandiri 30 (thirty) business days prior to such amendments becoming effective, or in accordance with the time period stipulated by the prevailing laws and regulations. The User is required to read well periodically any such changes so that if the User continues to access and/or purchase the Products, the User is deemed to have known, understood and agreed to such changes.
